Martinez Clínica de Odontología Especializada ("the Clinic," "we," "us"), located in Colombia. This policy describes what information we collect from visitors and prospective patients, how we use it, and what rights you have over it.

2. What information we collect

We collect the information you provide directly when you:

• Complete the assessment form on our site (name, contact details, procedure of interest)
• Book a free consultation
• Contact us via chat, email, SMS, or phone
• Subscribe to our communications

This includes:

• Contact details: name, email, phone, country of residence
• Clinical interest data: the dental procedure you're interested in (for example, Full Arch, Veneers, Clear aligners, Implants)
• Conversation data: messages you send us via SMS, email, or chat

3. How we use your information

We use your information to:

• Give you a cost estimate for the procedure you're interested in
• Contact you to schedule your free consultation

We do not use your information to make automated decisions that legally affect you, nor for purposes other than those described here without asking for your additional consent.

4. Legal basis for processing your data

Depending on where you live, we process your information under the following legal bases:

• If you live in the European Union or United Kingdom (GDPR/UK GDPR): we process your health information (procedure of interest) only with your explicit consent, which you can withdraw at any time. Your remaining contact data is processed based on your consent and our legitimate interest in responding to your request.
• If you live in Canada (PIPEDA / Quebec's Law 25, if applicable): we process your information based on your informed consent, limited to the purposes communicated to you at the time of collection.
• If you live in the United States: several states require affirmative (opt-in) consent before processing health data. That's why the checkbox for procedure of interest on our form is separate from the rest of the form, and is not pre-checked.

Dr. Juan C. Martinez Clínica de Odontología Especializada is not a regulated healthcare entity in the United States. The Health Insurance Portability and Accountability Act (HIPAA) applies to healthcare providers, insurers, and their business associates within U.S. jurisdiction; because the Clinic operates outside the United States, HIPAA does not directly govern the processing of your information. Even so, we apply the health data safeguards described in this policy regardless of your country of origin.

5. Who we share your information with

We do not sell your information to third parties. We share it only with:

• Providers that help us operate the site and communications (for example, appointment and messaging automation platform, web hosting)
• Our marketing agency, In-Sync Growth Partners, which manages these communications on our behalf under a confidentiality agreement
• Authorities, only when required by law

All of our providers are contractually required to protect your information and not use it for purposes other than those we authorize.

6. International data transfer

Dr. Juan C. Martinez Clínica de Odontología Especializada is located in Colombia. If you live in the European Union, United Kingdom, Canada, or the United States, when you send us your information it will be transferred to and processed outside your country of residence.

7. How long we keep your information

If you become a patient and a clinical record is created for you, we retain it for a minimum period of 15 years from the date of your last treatment, in accordance with Resolution 839 of 2017 (Resolución 839 de 2017), issued by Colombia's Ministry of Health and Social Protection, which governs the retention period for clinical records (the first 5 years in active files, and the following 10 years in central archives).

If your information remained only at the form/inquiry stage (you did not become a patient of the Clinic), we retain it for 24 months after your last contact with us, unless the law requires a different period. You may request deletion of your information at any time, subject to applicable legal exceptions.

8. Your rights

Depending on where you live, you have the right to:

• Access the information we hold about you
• Correct inaccurate information
• Request deletion of your information
• Withdraw your consent at any time (this does not affect processing carried out before the withdrawal)
• Object to the use of your information for marketing
• Request a portable copy of your data (EU/UK residents)
• File a complaint with your country's data protection authority

To exercise any of these rights, write to us at infoclinicajc@gmail.com. We will respond within the timeframe required by the law applicable to your location (typically between 30 and 45 days).

10. SMS and Email Communications

11. Information security

We apply reasonable technical and organizational measures to protect your information against unauthorized access, loss, or misuse. No system is 100% secure, and we recommend not sending us additional sensitive information (such as complete medical histories) through unencrypted forms on the site.

12. Minors

Our services are intended only for people over 18 years of age. The Clinic does not treat minors. We do not knowingly collect information from minors, and if we discover that a form was completed by a minor, we will delete that information.

13. Changes to this policy

We may update this policy occasionally. We will post the date of the last update at the top of the document. If the changes are significant, we will notify you through the contact channels we have available.

14. Contact
